Florida Law states that in order for an insurance policy to be in compliance with State Law, the policy must provide personal injury protection to the named insured, relatives residing in the same household, persons operating the insured motor vehicle, passengers in the motor vehicle, and other persons struck by the motor vehicle and suffering bodily injury while not an occupant of a self-propelled vehicle. The personal injury protection (PIP) insurance policy must be to a limit of $10,000 (sometimes $2,500) in medical and disability benefits and $5,000 in death benefits resulting from bodily injury, sickness, disease, or death arising out of the ownership, maintenance, or use of a motor vehicle.
As with any insurance policy by an insurance carrier, many insurance claims for injury and benefits are delayed or flat out denied.
Recently, the insurance carriers convinced Florida Legislature to enact a new law that requires an individual in an auto or motor vehicle accident to seek medical attention within 10 days of the accident, or the individual may forfeit his or her rights to seek a PIP – No Fault Insurance Benefit Payout.
