Many dog bite victims who are animal lovers are worried that if they file a claim or lawsuit it will result in the death of an animal. This is not the case, as seen in the below video.

Call 407.420.1044 today to schedule a confidential consultation with an Attorney at The Law Offices of Peter A. Shapiro & Jonathan D. Wilson. Discuss your legal rights, options and goals relating to your Dog Bite Injury Liability Case.

The State of Florida has laws that are meant to protect dog and animal attacks from occurring. These laws hold a dog owner liable for his or her dog biting or attacking another person.

Florida Statute 767.04 States: “The owner of any dog that bites any person while such person is on or in a public place, or lawfully on or in a private place, including the property of the owner of the dog, is liable for damages suffered by persons bitten, regardless of the former viciousness of the dog or the owners’ knowledge of such viciousness.”

The main exception to a dog owner’s liability is in the event it can be proven that the dog was provoked and that caused its aggression.

“However, any negligence on the part of the person bitten that is a proximate cause of the biting incident reduces the liability of the owner of the dog by the percentage that the bitten person’s negligence contributed to the biting incident.”

This language may seem to leave a broad interpretation of what is considered actions of provoking by the individual that was attacked. But what must be shown to a court to absolve the dog owner from liability is that the victim of the dog bite intentionally incited the dog to aggression.

The Law Offices of Peter A. Shapiro & Jonathan D. Wilson aggressively fights for dog bite injury victims in an effort to ensure they are fairly compensated for everything they are entitled to under the law. Depending upon the specific circumstances of a dog bite injury case, the victim may be entitled to seek compensation and damages for:

  • Injuries as a direct result of the accident or incident;
  • Lost Wages;
  • Medical Bills;
  • Pain and Suffering;
  • Permanent or long-term loss of quality of life;
  • And when there is a loss of life, families may also seek compensation in a wrongful death case.
